United Nations human rights experts have urged the Sri Lankan Government not to proceed with the proposed Prevention of Organized Crimes Bill in its current form, warning that several provisions could violate international human rights obligations and create risks of arbitrary detention, torture and unfair trials.
In a 31-page communication dated October 30, 2026, five UN human rights mandates raised serious concerns over the proposed legislation, which was gazetted on October 6.
The experts warned that the Bill could introduce powers similar to, and in some cases more extensive than, those contained in the controversial Prevention of Terrorism Act (PTA).
They acknowledged the need for stronger laws to combat organised crime but stressed that such measures must respect fundamental rights and judicial safeguards.
* Detention for up to one year: The Bill would allow the Secretary to the Ministry responsible for police to authorise detention at police stations for up to one year, including for questioning.
* Police confessions: Statements made to police officers of or above the rank of Assistant Superintendent could be admitted as evidence, with accused persons required to prove that statements were obtained through threats or coercion.
* Restrictions on media reporting: Journalists could face imprisonment for reporting on court proceedings covered by the Bill without prior court permission.
* Surveillance powers: Police could access certain telecommunications records without court approval, while other provisions would allow interception of communications and compelled decryption.
* Broad definition of organised crime: The legislation could potentially cover trade unions, student organisations and protest groups under certain circumstances.
The UN experts also questioned provisions allowing suspects to be held for up to 72 hours, excluding travel time, before being produced before a Magistrate.
They warned that prolonged police custody, combined with the admissibility of statements made to police, could increase the risk of torture and forced confessions.
The communication noted that the Human Rights Commission of Sri Lanka had already described the Bill as potentially more draconian than the PTA and recommended its withdrawal and substantial revision.
The experts further raised concerns that the legislation could affect journalists, lawyers, human rights defenders and individuals involved in peaceful protests.
They urged the Government to substantially revise the legislation following consultations with the Human Rights Commission, legal professionals, civil society organisations and affected communities.
The UN experts also requested clarification from the Government on 15 matters, including detention powers, judicial oversight, media restrictions, surveillance provisions and safeguards against torture.
The communication was issued under the mandates of UN experts dealing with torture, arbitrary detention, enforced disappearances, extrajudicial executions and violence against women and girls.
The experts stressed that combating organised crime was a legitimate government objective but that the proposed legislation must remain consistent with Sri Lanka’s international human rights commitments. (Newswire)
